These Terms of Service (“Terms”) govern your access to and use of the LoomfyMe desktop application, the loomfy.me website and any related services (together, the “Service”), operated by FELIPE RODRIGUES CELESTINO LTDA, registered at Av. Paulista, 1636, Bela Vista, São Paulo, SP, 01310-000, Brazil (“we”, “us” or “the Company”).
By downloading, installing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use LoomfyMe. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding contract.
2. Accounts
You may use the Free plan without an account. Paid features (Pro, Max) require a LoomfyMe account.
You are responsible for:
- Keeping your account credentials secure
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscription plans and billing
3.1. Plans
LoomfyMe offers three plans: Free, Pro and Max. Plan details, credit allowances and current prices are available at https://loomfy.me/en/pricing/.
3.2. Payment
Paid plans are billed through Paddle.com Market Limited (or its successor), which acts as our Merchant of Record. Paddle handles payment processing, currency conversion, tax collection and invoicing. By subscribing, you accept Paddle’s Buyer Terms in addition to these Terms.
3.3. Automatic renewal
Subscriptions automatically renew at the end of each billing cycle unless cancelled before renewal. You can manage your subscription in the customer portal.
3.4. Price changes
We may change prices with at least 30 days’ notice. Existing subscriptions continue at the previous price until the next renewal after the change takes effect.
3.5. Credits
Paid plans include a number of credits per billing cycle. Credits reset at the start of each cycle and do not roll over. Unused credits have no cash value and are not refundable.
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of applicable law
- Record any person without their informed consent where such consent is required by law
- Upload, process or distribute content that is illegal, infringing, defamatory or abusive
- Reverse engineer, decompile or attempt to extract the source code of the Service (except where permitted by mandatory law)
- Use the Service to develop a competing product
- Circumvent usage limits, credit quotas or access controls
- Share your account credentials with others
Violation of this section may result in immediate termination without refund.
5. Intellectual property
5.1. Our IP
The Service, including all software, designs, logos, text and documentation, is owned by the Company and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
5.2. Your content
You retain all rights to the recordings, transcripts, summaries and other content you create using LoomfyMe (“Your Content”). You grant us a limited license to process Your Content solely to provide the Service (for example, to transcribe audio when you use cloud features).
We do not claim ownership of Your Content and we do not use it to train AI models.
6. Third-party services
LoomfyMe integrates with third-party service providers to deliver its features, including payment processing, authentication, cloud transcription and AI-powered analysis. These third parties have their own terms and privacy policies, which apply when you use their services through LoomfyMe.
7. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement.
LoomfyMe uses AI models that may produce inaccurate or incomplete results. You are solely responsible for reviewing and verifying transcripts, summaries and other AI-generated output before relying on them for business, legal or personal decisions.
8. Limitation of liability
To the maximum extent permitted by law, the Company and its affiliates shall not be liable for any indirect, incidental, consequential, special or punitive damages, or for loss of profits, data, goodwill or other intangible losses, arising from or related to your use of the Service.
Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD 100, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless the Company and its directors, employees and agents from any claims, damages, losses or expenses (including legal fees) arising from your use of the Service or your violation of these Terms.
10. Termination
You may stop using the Service at any time. You may cancel paid subscriptions via the customer portal.
We may suspend or terminate your access if you violate these Terms, or if we are required to do so by law. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (IP, disclaimers, limitation of liability, indemnification, governing law) will continue in effect.
11. Refunds
Our refund policy is available at https://loomfy.me/en/refund/. We offer a 14-day refund window for paid subscriptions.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict of law principles. Any disputes arising from these Terms shall be submitted to the competent courts of the Comarca de São Paulo, SP, Brazil, unless mandatory law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on loomfy.me and updating the “Last updated” date. Continued use of the Service after changes means you accept the revised Terms.
